Splošni pogoji poslovanja spletne trgovine so sestavljeni v skladu z Zakonom o elektronskem poslovanju na trgu (ZEPT), Zakonom o varstvu potrošnikov (ZVPot), Obligacijskim zakonikom (OZ) in Zakonom o varstvu osebnih podatkov (ZVOP-1).

Uporabnika zavezujejo splošni pogoji, ki so veljavni v trenutku oddaje spletnega naročila. S potrditvijo naročila je uporabnik seznanjen s splošnimi pogoji poslovanja, varstvom osebnih podatkov in pravnim obvestilom.

 

Trgovec se zavezuje, da bodo uporabniku vselej na voljo:

  • podatki o identiteti Trgovca
  • kontaktni podatki, ki uporabniku omogočajo hitro in učinkovito komunikacijo s Trgovcem
  • informacije o bistvenih značilnostih izdelkov oz. storitev iz ponudbe spletne trgovine
  • informacije o dostopnosti izdelkov oz. storitev iz ponudbe spletne trgovine
  • način in pogoji dostave izdelkov
  •  informacije o načinu plačila
  • podatki o časovni veljavnosti ponudbe iz spletne trgovine
  • informacije o roku, v katerem je še možno odstopiti od pogodbe in pogojih za odstop
  • informacije o možnosti vračila izdelkov in o tem, če in koliko takšno vračilo stane uporabnika
  • informacije o postopku s pritožbo uporabnika ter podatki o kontaktni osebi Trgovca za stike z uporabniki

 

Spletna trgovina je odprta vsak dan, 24 ur na dan. Zaradi različnih tehničnih razlogov poslovanje prek spletne trgovine ali celo dostop do trgovine včasih ni mogoč. Zato si ponudnik pridržuje pravico, da za določen ali nedoločen čas omeji ali popolnoma ustavi dostop do strani spletne trgovine. Ponudnik ne prevzema odgovornosti za nedelovanje trgovine zaradi neznanja uporabe, kakršnih koli posledic zlorabe spletne trgovine, nedelovanje storitve zaradi izpada omrežja, izpada električne energije ali drugih tehničnih motenj, ki bi lahko začasno, lahko tudi za daljši čas, motile uporabo.

 

Vse cene so navedene v EUR (evrih) in vključujejo 22 % davek na dodano vrednost (DDV). Pridržujemo si pravico do spremembe cen brez predhodnega obvestila.

 

Kupoprodajna pogodba med ponudnikom in kupcem je sklenjena v trenutku, ko ponudnik potrdi naročilo. Od tega trenutka so vse cene in drugi pogoji fiksirani in veljajo tako za ponudnika, kot za kupca. Po oddaji naročila uporabnik prejme obvestilo po elektronski pošti, da je naročilo sprejeto oziroma zavrnjeno.

 

Na voljo je način plačila po predračunu. V svoj elektronski predal boste prejeli podatke za izvedbo plačila: znesek plačila, transakcijski račun, referenco oziroma sklic in namen plačila. V tem primeru naročeno blago plačate s splošnim plačilnim nalogom UPN (obrazec) na banki, pošti ali preko svoje spletne banke.

Prejeti predračun je potrebno poravnati najkasneje v 3 delovnih dneh. V kolikor znesek v tem času ni poravnan, se smatra, da kupec odstopa od naročila.

Opozorilo: pri plačilu po predračunu bodite pozorni na pravilno navedbo številke naročila v sklicu in/ali namenu plačila. Izvedeno nakazilo se šteje za plačilo predračuna samo, če je na plačilnem nalogu UPN navedena enaka številka naročila, kot ste jo za namen izvedbe plačila predračuna prejeli v vaš elektronski predal.

Prodajalec mora za dobavo blaga ali storitev izdati račun in ga izročiti kupcu. Pri poslovanju preko spleta račun izdamo ob pošiljanju blaga kupcu oziroma ko je blago odpremljeno. Kupec prejme račun skupaj z naročenimi izdelki.

 

Pri pogodbah, sklenjenih na daljavo ali zunaj poslovnih prostorov, ima potrošnik pravico, da v 14 dneh obvesti podjetje, da odstopa od pogodbe, ne da bi mu bilo treba navesti razlog za svojo odločitev.  Rok za pravico do odstopa od nakupa prične teči z dnem prevzema artiklov. Edini strošek, ki zaradi odstopa od kupoprodajne pogodbe bremeni uporabnika (kupca), je strošek vračila izdelkov.

Vrnjenemu blagu je potrebno priložiti kopijo računa in v celoti izpolnjen obrazec za vračilo blaga.  Kupljene izdelke je potrebno vrniti nepoškodovane, v originalni embalaži in v nespremenjeni količini. Ponudnik ni dolžan sprejeti pošiljk z odkupnino ali pošiljk, ki ne ustrezajo ponudnikovim splošnim pogojem poslovanja.

Po prejemu vrnjenih izdelkov, vam skladno z zakonom (nemudoma oziroma najpozneje v 14 dneh po prejemu obvestila) vrnemo znesek plačila. Zaradi zagotavljanja gotovosti, točnosti in pravočasnosti vračila ter zagotavljanja evidence o plačilih, se vračilo plačila kupcu izvede z nakazilom na enak način, kot je bilo izvedeno plačilo (na TRR kupčeve plačilne kartice).

Kupec nima pravice do odstopa od pogodbe, katere izdelek je prilagojen osebnim potrebam potrošnika oziroma je izdelek izdelan po njegovih natančnih navodilih.

Prodajalec si v primeru vračila blaga, ki bo umazano, poškodovano oz. bo njegova vrednost zmanjšana zaradi ravnanja kupca, ki ni bilo nujno potrebno za ugotovitev dejanskega stanja, pridržuje pravico kupcu zaračunati stroške v višini celotnega zneska oz. v višini, ki pomeni dejansko zmanjšanje vrednosti blaga.

 

Če je poštni paket, s katerim je uporabnik (kupec) prejel naročene izdelke, fizično poškodovan, če v njem manjka vsebina ali če kaže znake odprtja, mora uporabnik (kupec) sprožiti postopek reklamacije pri dostavni službi.

 

V primeru vračila blaga zaradi reklamacije je potrebno na naslov (elektronski naslov) ponudnika poslati reklamacijski zapisnik. Če je reklamacijski zahtevek upravičen, ima kupec pravico do drugega izdelka ali zahteve za vračilo kupnine. Vsak vrnjeni izdelek je kupec dolžan poslati po pošti na lastne stroške. Pošiljke z odkupnino ne bodo prevzete.

Prodajalec ne odgovarja za napake in morebitno nastalo škodo, ki nastane ob nepravilni uporabi in vzdrževanju izdelka.

Prodajalec ne odgovarja za stvarne napake na blagu, ki se pokažejo potem, ko mine eno leto, odkar je bila stvar izročena.

 

Trgovec bo naročene izdelke dostavil uporabniku (kupcu) v dogovorjenem roku. Vsa naročila so odposlana iz Slovenije s sledilno številko.  Dostavo na ozemlju republike Slovenije izvajamo v sodelovanju s Pošto Slovenije. Pošiljke odposlane na naslov izven države pa pošiljamo v sodelovanju z DHL, DPD ali GLS dostavno službo. Trgovec si pridržuje pravico izbrati drugo dostavno službo, če bo s tem lahko naročilo izpolnil učinkoviteje.

Spletna trgovina si prizadeva, da je blago po prejemu plačila dostavljena v najkrajšem možnem času – predvidoma v 2-5 delovnih dneh.

V primeru izbire osebnega prevzema : ko bo naročeno blago pripravljeno za prevzem, boste o tem obveščeni.

Ob sobotah, nedeljah in praznikih se dostava naročenih izdelkov ne izvaja.

 

Kupec je odgovoren, da z izdelki ravna skrbno in v skladu z njihovim namenom. Prodajalec ne jamči za poškodbe ali okvare na izdelku, ki so posledica nepravilne ali neskrbne uporabe.

What if my order does not arrive by the expected date?
If your order has not arrived by the estimated delivery time, please feel free to contact me via private message. A number of factors can influence like weather, holidays, strikes etc. If unfortunately this happens I politely ask for an additional 7 transit days. The usual problem is that a package is just stuck in a sorting facility. If after 7 additional transit days your order has not yet arrived, I will do my best to work with you towards a solution.

What happens if I provided the wrong shipping address?
It is the responsibility of the buyer to make sure that she or he enters the shipping address correctly. If you notice that you've entered the wrong address at checkout and your order hasn't shipped yet, message me ASAP!
If I already sent your package, I won’t be able to make changes to your order. If possible, try to collect your item from the address used at checkout.
If your order has already been shipped and it was unable to be delivered due to the wrong address the postal service will use the return address on the mailpiece and they will try to return it to the sender. Usually, the package is stored for a period that can vary depending on the courier who holds it and then returns it to me. When I will receive a returned package, I will contact you via email.

A gift recipient who isn't expecting a gift may refuse a package if they believe it's being delivered to them by mistake. You may want to let the recipient know that a surprise is on the way, to avoid the inconvenience of a possible return of a rejected package.

What if I want to return my purchase?
Only regular priced items may be returned and refunded. Unfortunately items on sale and custom made items can't be.
Before any returns are made please contact me within 14 days after you received your item. After that period of time I, unfortunately, can’t offer you a refund or exchange.
To be eligible for a return, your item must be unused and in the same condition that you received it. If the item is not in its original packaging and condition I reserve the right to refuse your return or deduct a charged based on its condition.
Once your return is received and inspected, I will send you an email to notify you that I have received your returned item. I will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to the original method of payment, within a certain amount of days.
If you choose to return your purchase, you collect all risks of loss or damage to the returned item while in transit. You should always consider using a trackable shipping service. It is your responsibility to inform me of a valid tracking number.

Customs and Duty Fees
Prices do not include customs fees, import taxes, duties, tariffs or other charges. Each country has its own laws and regulations.

What is customs clearance?
Customs clearance is a procedure during which a shipment is cleared to enter or leave a country. Without the document permitting the shipment to pass, the package cannot be delivered. Conditions vary from country to country, but for goods of a certain value, additional expenses can sometimes occur. In the event of duties, you will receive a notification, prompting you to pay the expenses. If you are unable to pay the duties, the package will be returned to the sender and additional charges may apply or returned to the shipment centre and held there for a specified amount of days; after this period the customer loses their right to claim the package.

Why do I need to pay customs duty?
All countries have a policy on importing goods. Even when you order something online from a different country, it must be cleared by the customs. During the customs procedure, officers check the country of origin of the package, the value of the package including transport charges and the quantity of goods. Sometimes you will be asked to provide the customs office with an invoice or proof of payment for the goods, to show the value. Every country has its own customs laws and the amount of duties varies for types of goods and different values.

What additional charges can I expect following the customs clearance?
You may be expected to pay customs import duties (percentage of shipment value and transport charges), local tax, and any regulatory charges (if applicable). The amount of charges depends on the value and the type of goods arriving into the country. However, I am unable to provide you with detailed information on customs fees and taxes, as they depend on the country of origin, country of arrival and the type and value of the goods. If you refuse to pay the customs fees and taxes and the package is returned to me I will not refund the cost of shipment. After 30 day, the customer loses their right to claim the package.

How are customs duties calculated?
All packages and shipments go through the import procedure, determined by customs’ law in the destination country. The shipment is cleared through customs based on the origin country, the value and quantity, but not its purpose. Additional duties need to be paid for certain goods. This is not included in the price you pay in my shop. In the event of duties, you will receive a notification, prompting you to pay the expenses. The calculation of duties depends on the value of the shipment.

Who is responsible for the payment of customs duties?
Duties and taxes are not included in the price. The buyer is responsible for paying customs duties on receipt of the package.
Requests to mark orders as 'Gift' on our customs forms to avoid the possibility of paying a customs fee or tax will be ignored. Marking purchased goods as 'Gifts' is illegal.

My friend sent me a gift. Why do I need to pay customs duty?
It does not matter if a package is a gift. Every shipment is subject to customs procedure. Additional duties need to be paid for certain goods. This is not included in the price in my shop.
